Terms of Service
Effective . This version replaces any earlier one.
1. Acceptance
These Terms of Service (the “Terms”) are a binding agreement between you and A.G. Software Technologies, based in Lucknow, India, which operates Thumbdesk (“Thumbdesk”, “we”, “us”). By creating an account, signing in, or otherwise using the Thumbdesk mobile apps, the host agent, this website or any related service (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Questions about these Terms go to support@thumbdesk.com.
2. Eligibility and accounts
- You must be at least 16 years old to use Thumbdesk. App store age ratings are separate distribution labels and do not change this minimum.
- You must be able to enter into a binding contract under the law of your country.
- Accounts are for one person. You may use Thumbdesk for personal work or your organisation’s internal work, but shared team accounts, organisation accounts and bot accounts are not currently supported.
- You are responsible for securing your phone, biometric access and email account. Keep these protected to prevent unauthorised access to your account and paired machines.
- You can delete your account at any time from Settings → Account → Delete Account.
3. Licence to the apps
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and run the Thumbdesk mobile app on devices you own or control, for your personal or internal business use. The licence covers the app as distributed through the Apple App Store and Google Play. You may not redistribute it, sell it, or offer it as part of a service to third parties.
4. The host agent
The Thumbdesk host agent is the program you install on the machines you want to reach from your phone. On the same terms as section 3, we grant you a licence to install and run the agent binaries we publish on machines you own or are authorised to administer. Releases are signed and published with checksums; install them from our official channels (the install script on our website, Homebrew, npm or our release pages) and do not redistribute modified copies.
Some earlier versions of the agent were published under the Apache License 2.0. Copies you obtained under that licence remain governed by it. That licence does not give you any right in the mobile apps, the backend service, the Thumbdesk name or its trademarks.
The agent runs with the permissions of the account that installed it. Approved phones can perform operations available to that account, including operations requiring administrator rights where those rights are available. Approve devices you control and revoke access for lost devices.
5. Acceptable use
You agree that you will not, and will not try to:
- use Thumbdesk to connect to a machine you do not own or are not explicitly authorised to operate;
- use the Service to commit a crime, or to harass, defraud or otherwise harm anyone;
- distribute malware, run denial-of-service attacks, or attack systems you do not own;
- resell, sublicense, white-label or commercially redistribute the app or the backend service;
- circumvent plan limits, entitlement checks, paywalls or device bindings;
- reverse engineer, decompile or disassemble the apps, the agent or the backend, except where applicable law allows it despite this restriction;
- use automated systems to create accounts, request sign-in codes, or load the Service beyond ordinary use;
- use the Service in a way that breaks Apple’s or Google’s published policies for their stores.
We may suspend or end access immediately, without notice, for a breach of this section.
6. Subscriptions and billing
Plans
Thumbdesk has a free plan with limits and a paid plan, Thumbdesk Pro, sold as a monthly subscription, a yearly subscription or a one-time Lifetime purchase. The pricing page describes them; the prices, features and limits shown in the app at the time of purchase are the ones that apply.
Who sells it
Every purchase is an in-app purchase made through the Apple App Store or Google Play. Apple or Google is the seller of record: they take the payment, handle your payment details and charge any applicable tax, and their terms apply to the payment itself.
Automatic renewal
Monthly and yearly subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple ID or Google account is charged within the 24 hours before the period ends. Manage or cancel in Settings → your name → Subscriptions on iOS, or Google Play → Payments and subscriptions → Subscriptions on Android. Deleting the app or your account does not cancel a subscription.
Free trials
Where a free trial is offered, it converts to the paid plan you chose at the end of the trial unless you cancel before then. Apple and Google show the conversion date in their subscription settings.
Refunds
Refunds are decided by Apple or Google under their own policies; we cannot refund an App Store or Google Play purchase directly. Request one at reportaproblem.apple.com or from Google Play. When a refund is granted we remove the matching entitlement.
Lifetime
Lifetime is a one-time purchase that grants Thumbdesk Pro for the period that we offer the Thumbdeskproduct. If we materially discontinue paid Thumbdesk features, we will give at least 90 days’ notice and handle refunds where the law or the store’s policy requires it.
Price changes
We may change prices. An increase applies to your subscription no earlier than the next renewal after the notice period Apple or Google requires, and asks for your consent again where their rules require it.
7. Google Play
If you get the app from Google Play, the Google Play Terms of Service also apply. Where these Terms conflict with them about how you obtain or use the app, the Google Play Terms win for that conflict.
8. Apple-required terms
These apply only when you get the Thumbdesk app from the Apple App Store, and replace Apple’s standard EULA.
- Acknowledgement. These Terms are between Thumbdesk and you, not Apple. Apple is not responsible for the app or its content.
- Scope of licence. Your licence is a non-transferable licence to use the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
- Maintenance and support. Thumbdesk alone is responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support for it.
- Warranty. Thumbdesk alone is responsible for any product warranties, express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app.
- Product claims. Thumbdesk, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including (a) product liability claims, (b) any claim that the app fails to conform to a legal or regulatory requirement, and (c) claims under consumer protection, privacy or similar legislation.
- Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, Thumbdesk, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms when using the app.
- Third-party beneficiary. You and Thumbdesk agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and that, once you accept them, Apple may enforce them against you as a third-party beneficiary.
9. Third-party services
The Service relies on third parties including Apple, Google, RevenueCat, Expo, our hosting provider (Hetzner) and Cloudflare. If you use the coding-agent features, the Claude Code, Codex or Grok CLI on your machine talks to Anthropic, OpenAI or xAI under your own account with them. Your use of those services is governed by their terms, and we are not responsible for their outages, data handling or billing practices.
10. Availability
We aim for high availability but do not offer a service-level agreement or service credits. Sign-in, pairing and connection setup depend on our backend, so maintenance, store outages, hosting problems, network failures and events outside our control can interrupt access.
11. No warranty
To the maximum extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that defects will be corrected. Nothing in these Terms limits rights you have under mandatory consumer law where you live.
12. Limitation of liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, data or goodwill, arising from or relating to the Service, even if we were told they were possible.
To the maximum extent the law allows, our total liability to you for anything arising from or relating to the Service is limited to the amount you paid for Thumbdesk in the twelve months before the event that gave rise to the claim. Nothing in this section excludes liability that cannot lawfully be excluded under your consumer law.
13. Indemnity
You will indemnify and hold Thumbdesk harmless against claims, damages, losses, liabilities and costs (including reasonable legal fees) arising from (a) your use of the Service, (b) your breach of these Terms or of the law, or (c) your access to or use of machines you were not authorised to access.
14. Termination
- By you: at any time, by deleting your account in the app. Cancel any subscription separately in your Apple ID or Google Play settings.
- By us: we may suspend or end your access if you breach these Terms (especially section 5), if the law requires it, or if we discontinue the Service. Where a breach can be fixed and is not serious, we will give you reasonable notice and a chance to fix it.
- When the agreement ends your licences end with it. Sections that by their nature should survive, including the warranty disclaimer, limitation of liability, indemnity and governing law, survive.
15. Changes to these Terms
We may update these Terms. The effective date at the top changes when we do; the first version took effect on 7 May 2026. For a material change we will tell you by email and in the app at least 14 days before it takes effect. Using the Service after that date means you accept the new version.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules, except that the mandatory consumer protections of your country of residence still apply. Disputes arising from the Service or these Terms go exclusively to the competent courts at Lucknow, Uttar Pradesh, India, except where mandatory consumer rules where you live let you bring proceedings in your local courts.
To the extent the law allows, you and Thumbdesk agree to resolve disputes individually, and you waive any right to take part as a plaintiff or class member in a class, consolidated or representative action against us. This waiver does not apply where the mandatory law of your country forbids it. Before any of that, please write to support@thumbdesk.com: almost everything is fixed faster by email.
17. Miscellaneous
- Entire agreement
- These Terms, the Privacy Policy and any in-app notices are the whole agreement between you and us about the Service.
- Severability
- If a provision is unenforceable, the rest stay in force.
- No waiver
- Not enforcing a provision does not waive our right to enforce it later.
- Assignment
- You may not assign these Terms. We may assign them as part of a merger, acquisition or sale of substantially all our assets, with notice to you.
- Force majeure
- Neither party is liable for failing to perform because of events outside its reasonable control.
- Notices
- We send notices in the app and to the email on your account. Notices to us go to support@thumbdesk.com.
- Language
- The English version of these Terms is the authoritative one; translations are for convenience.
